Terms Of Service
1. Introduction
This Terms of Service Agreement ("Agreement") governs your access to and use of the services provided by Terry Pilch Health Coach, LLC ("we," "us," or "our"), including our online course (“Brain Longevity Blueprint”), recipe library (“Healing Kitchen Collective”), and online shop (“Shop”) (collectively, the "Services"). By accessing or using the Services, purchasing products from the Shop, or signing up for the Course or Recipe Library, you agree to be bound by this Agreement.
Our Services are designed to provide educational resources on holistic health, nutrition, and wellness. We are not medically qualified practitioners, and our Services are for informational and educational purposes only. By using our Services, you acknowledge and accept that we:
- Are not medically qualified;
- Are not a substitute for advice from a qualified doctor;
- Recommend that you consult your doctor before making any changes to your diet or exercise regime or taking any dietary supplement;
- Do not warrant the accuracy of any information provided;
- Are not liable for any losses you may suffer by relying on our advice;
- Do not recommend any particular product;
- Are not a covered entity or a business associate of a covered entity under HIPAA.
If you do not agree with these terms, please do not use our Services.
2. Acceptance of Terms
By accessing or using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into this Agreement.
We reserve the right to update or modify this Agreement at any time. We will notify you of changes by posting the revised Agreement on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new terms.
3. Description of Services
- Brain Longevity Blueprint Video Training: Our online Course provides educational content on brain health, gut health, nutrition, stress management, sleep optimization, and related topics. The Course is delivered through video lessons, worksheets, and other digital materials. Access is granted upon purchase and is non-transferable.
- Healing Kitchen Collective: The Healing Kitchen Collective offers a collection of recipes focused on nutrient-dense, healing foods to support gut/brain health and energy. Access may be included with the Course or purchased separately, and recipes are for personal use only.
- Our online Shop: Our Shop offers nutritional supplements, wellness products, and related items. All sales are final unless otherwise stated. Products are not intended to diagnose, treat, cure, or prevent any disease.
We may update or discontinue any part of the Services at any time without notice.
4. User Responsibilities
You agree to:
- Provide accurate information when creating an account or making purchases.
- Use the Services only for personal, non-commercial purposes.
- Not copy, reproduce, distribute, or create derivative works from any Brain Longevity Blueprint Course materials, Healing Kitchen Collective recipes, or content without our prior written permission.
- Not share your login credentials or allow unauthorized access to the Services.
- Comply with all applicable laws and regulations.
You are solely responsible for any changes to your diet, exercise, or supplement regimen based on our Services. We strongly recommend consulting a qualified healthcare professional before implementing any advice.
5. Payments and Refunds
- Payments: All purchases are processed through secure third-party payment processors. By making a purchase, you authorize us to charge your payment method for the applicable fees, including any taxes.
- Refunds: Due to the digital nature of the Course and Recipe Library, all sales are final and non-refundable.
- Subscriptions: If applicable (e.g., ongoing access to Recipe Library), subscriptions renew automatically unless canceled. You may cancel at any time, but no refunds will be issued for partial periods.
6. Intellectual Property
All content in the Course, Recipe Library, and Shop, including videos, recipes, text, graphics, and logos, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the content for personal purposes only. You may not reproduce, distribute, or use the content for commercial purposes without our written consent.
7. Medical and Health Disclaimer
We are nutritionists and holistic health coaches, not licensed medical professionals. Our Services, including the Course, Recipe Library, and products in the Shop, are for educational purposes only and do not constitute medical advice, diagnosis, or treatment.
You should consult your doctor:
- Before making changes to your diet, exercise, or supplements;
- Before beginning any therapy.
We do not dispense or prescribe prescription products. Any product information is for educational purposes and not an endorsement. We are not liable for adverse effects from any information or products.
8. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information, including any medical or test data shared with us. That information is not protected by doctor-patient confidentiality and is not governed by HIPAA.
9. Limitation of Liability
